It looks like weed in Thailand suffered a minor setback this week.
While we were all expected some rules eventually, the new regs that came down from the Ministry of Public Health caught some people by surprise.
Nothing major but the new rules do put some new restrictions in place.
According to Google Translate, here are the relevant changes people should be aware of:
Article 3 Anyone who wishes to study, research, export, sell or process controlled herbs for trade This can be done only after obtaining a license under section 46 and the licensee must comply with the following conditions:
(1) the licensee for study, research, export, distribution or processing of controlled herbs for trade must: Provide information on the source, use, and quantity stored at the facility. and provide information reports to the Registrar in the form prescribed by the Director-General.
(2) a licensee to export controlled herbs for trade must provide export details to the licensor on a one-time basis according to the form prescribed by the Director-General
(3) prohibiting the distribution of controlled herbs; or processing controlled herbs for trade to those who are old under twenty years pregnant women or lactating women;
(4) Prohibit the sale of controlled herbs. or processing controlled herbs for trade to students student
(5) It is forbidden to sell controlled herbs for smoking in the workplace. except for distribution by medical practitioners According to the law on the medical profession Thai traditional medicine practitioner Practitioner of Applied Thai Traditional Medicine Certified indigenous healers according to the Ministry of Public Health Regulations on Certification of Indigenous Healers B.E. 2562 (2019) and its amendments. According to the law on profession Thai traditional medicine Traditional Chinese Medicine Practitioner According to the law on the practice of the art of healing and dental practitioners according to the law on dental practice used to treat their patients or a veterinary practitioner according to the law on the veterinary profession used to treat animals
(6) Prohibit the sale of controlled herbs. or products processed from controlled herbs for trade through vending machines via electronic channels or computer networks
(7) It is forbidden to advertise controlled herbs in all trade channels;
(8) It is forbidden to sell controlled herbs. or products processed from controlled herbs for trade in the following locations
(a) a temple or a place for performing religious ceremonies
(b) a dormitory according to the dormitory law
(c) Public parks, zoos and amusement parks.
Article 3 mostly says that anyone wishing to engage in cannabis for commercial purposes needs a license. People were mostly complying with that anyway but now it's more defined.
Section 1 seems aimed at researchers, exporters, and cannabis product manufacturers in regards to record keeping and notifications.
Section 2 is aimed at exporters and seems quite reasonable.
Section 3 is a rehash of not allowing sales of cannabis to pregnant or lactating women.
Section 4 is a rehash of existing rules preventing the sale of cannabis to people under 20.
Section 5 of Article 3 is where things are a little hazy. It sounds like you will not be able to sell cannabis and offer on-site consumption unless there is a doctor (or a veterinarian or dentist) present.
That can easily be addressed if each dispensary has a doctor on staff at all times.
It also doesn't seem to address smoking areas that are on-site but not subject to any other prohibitions. For instance, what if a dispensary has a rooftop area?
Section 6 is where we get something worrisome. It says no vending machine sales, which is probably just a good idea, but it also prohibits online sales.
Section 7 prohibits advertising. Again, fairly reasonable and basically the same as alcohol.
Section 8 simply defines places where cannabis cannot be sold. No surprises there.
So, really, no smoking on-site at dispensaries, no online sales, and no advertising are the three biggies that stand out.
The online sales seems to be the most problematic of them all as many dispensaries only exist online with no physical storefront. I'm guessing most of the online sellers also never bothered to obtain a license or sell cannabis nor even bother to register as a company.
We can probably expect that online dispensaries won't disappear but they'll likely be less brazen when promoting themselves online.
